Trust Formation & Trustee Services

A trust is a governance decision before it is a tax one. We work with families and their advisors to establish the right structure, then carry the administrative discipline that keeps it respected: proper trustee minutes, clean accounts and distributions that follow the deed.

Hong Kong trust set-up and administration

Primasia establishes and administers Hong Kong trust structures for international and local families and corporates. Our team works through the regulatory landscape with you, from the initial structuring decision and drafting of the trust deed through to ongoing administration and distribution.

Trusts are typically used for inheritance and tax planning, asset protection across borders, protection of beneficiaries and long-term succession planning. Hong Kong's stable legal system and favourable tax environment make it a durable base for holding and passing on wealth.

Discretionary and fixed-interest trusts

A discretionary trust gives trustees the ability to determine distributions to beneficiaries, offering flexible asset management, privacy and the capacity to respond to changing family circumstances. It suits estate management where needs are varied or not yet known.

A fixed-interest trust sets entitlements in advance, delivering predictable income and stability. It suits beneficiaries and settlors who prioritise certainty over flexibility.

Private trust companies and charitable trusts

A private trust company (PTC) gives a family direct governance over its own trust structures, with greater control and confidentiality than an external trustee arrangement. We advise on whether a PTC is proportionate, and set up and administer both Hong Kong and BVI private trust companies.

For philanthropy, we structure charitable purpose trusts to meet regulatory requirements while maximising the impact of the giving, and support them with the transparency and accountability charitable initiatives require.

Ongoing trust administration

Administration covers the legal, financial and administrative work of running the trust: maintaining records and accounts, managing the relationship with beneficiaries, coordinating with lawyers and investment managers, and keeping the structure compliant as regulation changes.

Trust services are provided through our related trust company; further detail is available at pmichk.com.

FAQs

Trusts: questions we are asked most

Does Primasia set up Hong Kong private trust companies?+

Yes. We advise on and establish private trust company structures in Hong Kong and the BVI, covering the corporate formation, licensing considerations, compliance framework and ongoing administration.

What makes a Hong Kong trust attractive?+

A stable common law framework, strong asset protection and confidentiality, considerable structuring flexibility and a tax-efficient environment, combined with Hong Kong's position as a financial hub with deep trust and wealth management expertise.

How is a trust company set up in Hong Kong?+

In outline: reserve and register the company at the Companies Registry, obtain a Trust or Company Service Provider (TCSP) licence, meet the capital requirements, appoint directors, maintain a Hong Kong office, and put anti-money laundering and reporting procedures in place. Legal advice on the trust deed itself is taken alongside the corporate work.

What does a Hong Kong trust cost to run?+

Costs fall into establishment fees, annual maintenance and transaction or administration fees. The range depends on the structure, asset types and activity levels, so we quote against the specific structure rather than a standard tariff.

Do you provide family trust administration?+

Yes: establishment and ongoing administration of family trusts, including record keeping, distributions, regulatory compliance and coordination with the family's legal and investment advisers.
